You represent that you are at least 18 years old or have reached the age of majority in your jurisdiction and possess the legal authority to enter into these General Terms.
McQueen Homes may revise these General Terms at any time by posting the updated version on the Services. Your continued use after the effective date of any changes constitutes acceptance of the revised terms.
4.1. You may use the Services for lawful purposes and in accordance with these General Terms. Unauthorized commercial use, data scraping, or automated access is prohibited.
4.2. You must not interfere with the security, availability, or performance of the Services.
5.1. When creating an account, you must provide accurate, current, and complete information and promptly update it as needed.
5.2. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
5.3. McQueen Homes may suspend or terminate accounts that violate these General Terms or applicable law.
6.1. You retain ownership of content you submit to the Services but grant McQueen Homes a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content to operate and improve the Services.
6.2. You represent that you have all rights necessary to submit the content and that it does not infringe, violate, or misappropriate any third-party rights.
6.3. McQueen Homes reserves the right to remove user content that violates these General Terms or is otherwise objectionable.
7.1. All content, trademarks, logos, and software on the Services are owned by or licensed to McQueen Homes and are protected by intellectual property laws.
7.2. You may not reproduce, distribute, create derivative works from, or publicly display any portion of the Services without express written consent from McQueen Homes.
The Services may contain links to third-party websites or resources. McQueen Homes is not responsible for the content, products, or services on or available from those resources, and your use is at your own risk.
McQueen Homes' collection and use of personal information are described in its Privacy Policy, which is incorporated by reference into these General Terms. By using the Services, you consent to the storage and processing of your data in the United States and the Dominican Republic, regardless of your country of residence, subject to applicable privacy and data protection laws.
10.1. You agree to comply with all applicable laws, regulations, and ordinances related to your use of the Services, including housing, rental, consumer protection, anti-money-laundering, and data privacy laws in the United States and, where relevant, in the Dominican Republic.
10.2. If you access the Services from outside the United States or the Dominican Republic, you are responsible for compliance with local laws in addition to these General Terms.
The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. McQueen Homes disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, McQueen Homes and its affiliates are not liable for any indirect, incidental, consequential, or punitive damages arising from or related to your use of the Services. McQueen Homes' total liability for any claim will not exceed the amount you paid (if any) for the Service giving rise to the claim in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless McQueen Homes, its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of your use of the Services, your violation of these General Terms, or your violation of applicable law.
14.1. If your dispute arises from Services related to Properties located in the United States, these General Terms are governed by the laws of the state in which the relevant Property is located, without regard to conflict of law principles, and disputes will be brought in the state or federal courts located in that state.
14.2. If your dispute arises from Services related to Properties located in the Dominican Republic, these General Terms are governed by the laws of the Dominican Republic, and disputes will be brought in the competent courts of Santo Domingo, National District.
14.3. For disputes unrelated to a specific Property, these General Terms are governed by the laws of the State of Maryland, United States, and the parties submit to the exclusive jurisdiction of the state and federal courts located in Prince George's County, Maryland.
You represent that you are not located in, under the control of, or a national or resident of any country or person on any U.S. or Dominican Republic sanctions list. You agree not to use the Services in violation of applicable export control or economic sanctions laws.
McQueen Homes may suspend or terminate your access to the Services at any time for any reason, including violations of these General Terms. Upon termination, your right to use the Services will immediately cease, but provisions that by their nature should survive will remain in effect.
These General Terms constitute the entire agreement between you and McQueen Homes regarding the Services and supersede all prior or contemporaneous communications.
