Terms and Conditions

1. Acceptance of Terms

By accessing or using the McQueen Homes booking platform (the "Platform"), you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree, you must not use the Platform. You represent that you are at least 18 years old and have the authority to enter into these Terms.

2. Scope of Services

2.1. The Platform enables users to browse, request, and confirm short-term stays and related hospitality services offered by McQueen Homes or its authorized property partners (collectively, the "Properties").

2.2. Properties may be located in the United States or the Dominican Republic. Additional country- or jurisdiction-specific rules, taxes, and guest obligations may apply based on the Property location. McQueen Homes will communicate location-specific requirements during the booking process or in your confirmation materials.

2.3. McQueen Homes may make changes to available Properties, amenities, and Platform functionality at any time without notice.

3. Account Registration and Security

3.1. You must create an account to submit booking requests. You agree to provide accurate, current, and complete information during registration and to keep your credentials confidential.

3.2. You are responsible for all activity conducted under your account. Notify McQueen Homes immediately of any unauthorized use or security breach.

3.3. McQueen Homes may suspend or terminate accounts that violate these Terms or applicable law.

4. Booking Requests and Confirmations

4.1. Submitting a booking request authorizes McQueen Homes to confirm availability, pricing, location-specific taxes, and applicable fees. A booking is not confirmed until you receive written confirmation from McQueen Homes.

4.2. McQueen Homes reserves the right to refuse or cancel bookings at its discretion, including without limitation where payment cannot be processed, the Property becomes unavailable, or the stay would violate local occupancy or licensing rules.

4.3. You agree to review confirmation details for accuracy and notify McQueen Homes within 24 hours of any discrepancies.

5. Fees, Taxes, Currency, and Payments

5.1. You agree to pay all nightly rates, cleaning fees, taxes, tourism levies, and other charges disclosed during the booking process.

5.2. Charges for Properties located in the Dominican Republic may be quoted in Dominican pesos (DOP) or United States dollars (USD). Currency conversions may be performed by your payment provider and are outside McQueen Homes' control.

5.3. Payment is due upon confirmation unless otherwise stated in writing. McQueen Homes may process charges through third-party payment processors subject to their terms.

5.4. You authorize McQueen Homes to pre-authorize or charge a security deposit where applicable to cover incidentals or damages.

5.5. You are responsible for understanding and complying with all tax obligations arising from your stay in the jurisdiction where the Property is located.

6. Cancellations and Refunds

6.1. Cancellation policies are presented during checkout and in your confirmation email. Refund eligibility depends on the specific policy attached to your booking.

6.2. McQueen Homes is not responsible for charges imposed by payment providers or currency conversion services.

6.3. In the event of force majeure, border closures, public health restrictions, or Property unavailability, McQueen Homes may, at its discretion, relocate you to a comparable Property, rebook the stay, or issue a refund of unused nights.

7. Travel Documentation

7.1. If your booking requires international travel, you are solely responsible for obtaining passports, visas, health certifications, or other documentation needed to enter or remain in the destination country.

7.2. McQueen Homes is not liable for disruptions caused by incomplete travel documentation or customs requirements.

8. Check-In, Stay Conduct, and Check-Out

8.1. You must comply with check-in and check-out times communicated in your confirmation.

8.2. You agree to use the Property only for lawful, residential purposes and in accordance with occupancy limits, house rules, and community guidelines provided by McQueen Homes.

8.3. You are liable for any damage, loss, or excessive cleaning required due to your stay beyond normal wear and tear. McQueen Homes may charge repair or replacement costs to the payment method on file.

8.4. McQueen Homes may access the Property with reasonable notice for maintenance, safety, or emergency purposes.

9. Guest Obligations

9.1. Maintain quiet enjoyment for neighbors and comply with all applicable laws, association rules, and safety instructions.

9.2. Do not sublet, host parties, or allow more occupants than approved without written consent.

9.3. Immediately report maintenance or safety issues to McQueen Homes.

10. Property Standards and Services

10.1. McQueen Homes endeavors to ensure that descriptions, photos, and amenities listed on the Platform are accurate; however, minor variations may occur.

10.2. Availability of amenities such as parking, Wi-Fi, or special equipment is not guaranteed unless expressly confirmed in writing.

10.3. Amenities and safety equipment may differ between Properties in the United States and the Dominican Republic to comply with local building codes and regulations.

11. Privacy and Data Use

McQueen Homes collects and processes personal data in accordance with its Privacy Policy. By using the Platform, you consent to the transfer and processing of your information in the United States and the Dominican Republic for booking administration, customer service, and compliance purposes, regardless of your country of origin.

12. Intellectual Property

All Platform content, trademarks, and technology are owned or licensed by McQueen Homes. You may not reproduce, distribute, or modify any portion of the Platform without prior written consent.

13. Prohibited Activities

You agree not to:

(a) Use automated means to access the Platform;

(b) Interfere with the security or operation of the Platform;

(c) Disparage or misrepresent McQueen Homes or the Properties;

(d) Use the Platform for fraudulent or unlawful purposes, including violations of U.S. or Dominican Republic law.

14. Disclaimer of Warranties

14.1. The Platform and Properties are provided "as is" and "as available" without warranties of any kind, express or implied.

14.2. McQueen Homes does not guarantee uninterrupted or error-free Platform access, nor does it guarantee the availability of any particular Property.

15. Limitation of Liability

15.1. To the maximum extent permitted by law, McQueen Homes and its affiliates are not liable for indirect, incidental, consequential, or punitive damages arising out of your use of the Platform or stay at a Property.

15.2. McQueen Homes' total liability under these Terms will not exceed the amounts you paid for the booking giving rise to the claim.

16. Governing Law and Dispute Resolution

16.1. These Terms are governed by the laws of the jurisdiction where the booked Property is located (for U.S. Properties, the laws of the state in which the Property sits; for Dominican Republic Properties, the laws of the Dominican Republic), without regard to conflicts of law principles.

16.2. Any dispute arising out of or relating to these Terms will first be addressed through good-faith negotiations. If unresolved, the parties agree to submit the dispute to binding arbitration or mediation in the same jurisdiction as the Property, except where prohibited by law. Nothing in this clause limits either party's right to seek injunctive relief in a court of competent jurisdiction.

17. Compliance With Local Regulations

You agree to comply with all health, safety, housing, tourism, and immigration regulations applicable to the Property location, including any registration requirements imposed on guests in the Dominican Republic.

18. Modifications

McQueen Homes may update these Terms at any time by posting a revised version on the Platform. Continued use of the Platform after changes take effect constitutes acceptance.
